Welcome to The Heirloom Society. These Terms of Service (“Terms”) govern your use of www.the-heirloom-society.com (the “Website”) and any purchases, commissions, or services offered by The Heirloom Society (“we,” “us,” or “our”).
By accessing the Website, placing an order, or requesting a commission, you agree to these Terms. If you do not agree, please do not use the Website.
About Our Artwork
The Heirloom Society creates one-of-a-kind, handcrafted miniature art using antique porcelain, repurposed heirloom vessels, collected objects, decorative miniatures, and other curated materials.
Because many components are antique, previously owned, handmade, or naturally aged, they may display variations, patina, discoloration, crazing, surface marks, worn gilding, or other signs of age. These characteristics are part of each piece’s history and are not necessarily considered defects.
Unless expressly stated otherwise, our artwork is intended for decorative display only. It is not a toy, food-safe vessel, planter, or functional household item. Pieces may contain small, delicate, sharp, or breakable components and should be kept away from children and pets.
2. Product Descriptions and Photography
We make reasonable efforts to describe and photograph each piece accurately. However:
Colors and proportions may appear differently depending on lighting, photography, screen settings, and device displays.
Measurements are approximate unless otherwise stated.
Antique materials may contain imperfections that are difficult to capture in photographs.
Historical details, dates, makers, and origins are provided based on available markings, research, or information received with an item and are not guaranteed unless expressly authenticated.
Please review all photographs and descriptions carefully before purchasing. You may contact us with questions before placing an order.
3. One-of-a-Kind Availability
Most pieces are singular works and cannot be exactly reproduced. Placing an item in a shopping cart does not reserve it. A purchase is not confirmed until payment has been successfully processed and you receive an order confirmation.
Although we work to keep availability accurate, an item may occasionally sell through another channel before the Website updates. If this occurs, we will cancel the unavailable order and refund the amount paid.
4. Orders and Payment
All prices are listed in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and other fees will be shown during checkout when possible.
You agree to provide current, complete, and accurate billing, shipping, and contact information. We may refuse or cancel an order when we reasonably suspect fraud, unauthorized payment activity, pricing errors, inventory errors, misuse of the Website, or a violation of these Terms.
Payment is processed through third-party payment providers. We do not directly control how those providers collect, store, or process your financial information.
5. Custom Commissions
Custom commissions are subject to availability and acceptance by The Heirloom Society. A commission is not confirmed until the required payment or deposit has been received and the project details have been approved in writing.
Because commissions are created by hand using distinctive materials:
Inspiration images and examples establish general creative direction but do not guarantee an exact reproduction.
Final placement, composition, materials, and artistic details remain subject to our creative judgment.
Antique or discontinued elements may be replaced with materials of a similar character when necessary, with your approval when the change is substantial.
Completion dates are estimates and may change due to sourcing, material availability, curing time, or unforeseen circumstances.
Reasonable design revisions may be included as stated in the individual commission agreement. Additional revisions may require an additional fee.
Work may begin after design approval, at which point deposits or payments may become nonrefundable to the extent stated in the commission agreement and permitted by law.
Customer-supplied heirlooms will be handled with reasonable care. However, antique and fragile objects can contain unseen weaknesses. Any special arrangements concerning valuable or irreplaceable materials should be documented in the commission agreement before work begins.
You confirm that you have the legal right and permission to provide any objects, photographs, names, text, or other materials submitted for a commission.
6. Shipping and Delivery
Processing and shipping estimates are provided in good faith but are not guaranteed delivery dates. We are not responsible for carrier delays, severe weather, incorrect addresses, customs delays, or other circumstances outside our reasonable control.
If we cannot ship within the timeframe promised—or within the period required by applicable law—we will provide any legally required delay notice, cancellation option, or refund.
Customers are responsible for entering a complete and accurate delivery address. Additional shipping costs caused by an incorrect or incomplete address may be charged to the customer.
International customers are responsible for any applicable customs duties, taxes, brokerage charges, or import restrictions.
7. Damaged or Missing Orders
Our artwork is carefully packaged due to its fragile nature. Please inspect your order promptly after delivery.
If an order arrives damaged or an item is missing, contact us at katie.oconnell.tx@gmail.com within [three] calendar days of delivery. Include:
Your order number;
Photographs of the damaged artwork;
Photographs of the inner and outer packaging; and
A description of the damage or missing item.
Please retain the artwork and all packaging while the claim is reviewed. Do not discard, repair, alter, or return a damaged piece without instructions from us, as the shipping carrier may require the original packaging for a claim.
Available resolutions may include repair, replacement when reasonably possible, store credit, or a refund, depending on the circumstances and applicable law. Because each work is one of a kind, an identical replacement may not be possible.
8. Returns and Cancellations
Returns, exchanges, and order cancellations are governed by the Return Policy displayed on the Website at the time of purchase.
Unless otherwise stated in that policy or required by law:
Custom, commissioned, personalized, and made-to-order pieces are final sale.
Shipping charges are nonrefundable after an order has shipped.
A change of mind, minor color variation, signs of age disclosed in the listing, or differences inherent in handmade work will not generally be considered damage or a product defect.
Nothing in these Terms limits any non-waivable rights available to you under applicable consumer-protection law.
9. Care and Display
Customers are responsible for the appropriate care and display of purchased artwork. Pieces should be handled gently and protected from falls, moisture, extreme temperatures, prolonged direct sunlight, and access by children or pets.
We are not responsible for damage caused after delivery by mishandling, improper display, attempted cleaning, repairs, modifications, ordinary aging, or failure to follow care guidance.
10. Website Content and Intellectual Property
The Website and its original content—including artwork designs, photographs, written descriptions, collection names, graphics, branding, logos, and layout—are owned by or licensed to The Heirloom Society and are protected by applicable intellectual-property laws.
You may view the Website for personal, noncommercial purposes. You may not reproduce, modify, publish, distribute, sell, commercially exploit, or create derivative works from our content without prior written permission.
Purchasing an artwork transfers ownership of the physical object only. It does not transfer copyright, reproduction rights, commercial licensing rights, or ownership of the underlying design or photographs.
11. Customer Submissions and Reviews
If you submit a review, testimonial, photograph, comment, or other content to us, you confirm that the submission is yours or that you have permission to share it.
Unless we agree otherwise in writing, you grant The Heirloom Society a nonexclusive, royalty-free license to use, reproduce, and display voluntarily submitted reviews and related content for Website, portfolio, social-media, and promotional purposes. Please contact us if you would like us to stop using a submission where reasonably possible.
We will not knowingly publish private commission details, personal photographs, or sensitive memorial information for promotional purposes without appropriate permission.
12. Prohibited Uses
You may not use the Website:
For unlawful, fraudulent, or deceptive purposes;
To interfere with the Website’s security or operation;
To introduce malicious code or attempt unauthorized access;
To scrape, copy, or commercially exploit Website content;
To impersonate another person or submit false information; or
To infringe the rights of The Heirloom Society or any third party.
We may restrict access to the Website when we reasonably believe these Terms have been violated.
13. Third-Party Services and Links
The Website may contain links to or integrations with third-party services, including payment processors, shipping carriers, social-media platforms, and affiliate partners. We do not control and are not responsible for the availability, content, security, policies, or practices of third-party services.
Your use of a third-party service may be governed by that provider’s own terms and privacy policy.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis. We do not guarantee that the Website will always be uninterrupted, secure, error-free, or free from harmful components.
Any warranties that cannot legally be excluded remain in effect as required by applicable law.
15. Limitation of Liability
To the fullest extent permitted by law, The Heirloom Society and its owners, employees, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or purchase of our products.
Where liability cannot be excluded, our total liability relating to a particular purchase will not exceed the amount you paid for the product or service giving rise to the claim, except where a different remedy is required by law.
This section does not exclude liability that cannot legally be limited or waived.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless The Heirloom Society and its owners, employees, and representatives from claims, losses, or expenses arising from your unlawful use of the Website, your violation of these Terms, or your infringement of another person’s rights.
17. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal proceeding arising from these Terms or your use of the Website will be brought in a court of competent jurisdiction located in Dallas County, Texas.
18. Changes to These Terms
We may update these Terms periodically. The revised version will be posted on this page with a new effective date. Changes apply prospectively unless otherwise required by law.
Your continued use of the Website after revised Terms become effective constitutes acceptance of those revised Terms.
19. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, Return Policy, Shipping Policy, and any written commission agreement, constitute the complete agreement relating to your use of the Website and purchases from The Heirloom Society.
If a specific written commission agreement conflicts with these general Terms, the commission agreement will control for that project.
